Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Drape Labs Inc. ("Drape", "we", "our"). By creating an account or using our AI virtual try-on platform (the "Service"), you agree to these Terms. If you don't agree, please don't use the Service.

1. Agreement

You must be at least 13 years old (16 in the EEA) to use Drape. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. The Service

Drape provides an AI-powered virtual try-on platform that lets you upload a photo of yourself or another person (with their permission) and a garment image, and generates a synthesized image showing what the garment would look like on the model. The Service may also include adjacent features such as an AI stylist, image archives, an API, and subscription billing.

We work hard to keep the Service available 24/7, but we don't guarantee uninterrupted access. Maintenance, model updates, and third-party outages (e.g., FAL, OpenAI, Supabase) may occasionally affect performance.

3. Accounts

You're responsible for keeping your account credentials secure and for everything that happens under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

One account per person. You may not share, transfer, or sell your account. Sharing a paid account with others to circumvent credit limits is prohibited.

4. Your Content

"Your Content" means the photos, garments, and prompts you upload to Drape. You retain ownership of Your Content. You grant Drape a non-exclusive, worldwide, royalty-free license to process, store, transmit, and display Your Content solely to operate and improve the Service for you (e.g., to send it to our AI model providers to generate try-on results, to store results in your private archive, and to display them in your dashboard).

We do not train our models on Your Content. Generated images are stored privately in encrypted storage and accessible only via short-lived signed URLs.

You represent and warrant that (a) you own Your Content or have all necessary rights to upload it, (b) you have the consent of every identifiable person shown in the photos, and (c) Your Content does not infringe any third-party rights or violate any law.

5. License Terms for Generated Images

• Atelier (free) plan: Generated images are licensed to you for personal, non-commercial use only.
• Studio plan: Includes a commercial license — you may use generated images in marketing, social, lookbooks, and online stores, subject to these Terms.
• Couture plan: Full commercial license including API redistribution within your own product, subject to fair-use thresholds.

You may not use generated images to defame, deceive, or impersonate any real person without their consent. You may not claim AI-generated images as photographs of real events.

6. Acceptable Use

You agree not to:

• Upload images of people without their explicit permission.
• Generate non-consensual intimate imagery (NCII), CSAM, hate speech, or anything that violates applicable laws.
• Use the Service to create deepfakes intended to deceive (e.g., political misinformation, fraud, impersonation).
• Reverse-engineer, scrape, or attempt to extract model weights or training data.
• Resell, redistribute, or sublicense the raw Service to third parties (with the exception of the Couture API license).
• Interfere with rate limits, abuse free credits, or circumvent paywalls.

We may suspend or terminate accounts that violate these rules without notice or refund.

7. AI Disclaimer

Drape uses generative AI models. AI outputs are probabilistic — they may include artifacts, unrealistic details, or unexpected results. We make no warranty that any specific try-on will be flattering, accurate, or fit-correct.

Always verify garments in person before purchase decisions. Drape is a styling and visualization tool, not a fitting service.

8. Billing & Credits

Subscriptions are billed monthly or annually in advance, in USD, via our payment processor (Stripe). Credit packs are charged once. All purchases consume credits: 1 credit = 1 completed AI try-on. Failed generations do not consume credits.

Subscription credits reset at the start of each billing cycle and do not roll over. Credit-pack credits never expire and stack on top of subscription credits.

Prices may change with 30 days' notice for existing subscribers; new prices apply only after your current period ends.

9. Cancellation

You may cancel your subscription at any time from your profile. Cancellation takes effect at the end of the current billing period. You retain access until that date and may continue to use any remaining credit-pack credits indefinitely.

10. Termination

We may terminate or suspend your access immediately, without notice, if you breach these Terms, violate the Acceptable Use rules, or if required by law. Upon termination, your right to use the Service ends and we may delete Your Content after 30 days.

11. Intellectual Property

The Service, including its UI, code, models (those owned by Drape), trademarks, and documentation, are owned by Drape and its licensors. Nothing in these Terms transfers any ownership to you, except for the limited license to Your Content as described in Section 5.

12. Limitation of Liability

To the maximum extent permitted by law, Drape's total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages, including lost profits or reputational harm.

The Service is provided "as is" without warranties of any kind, express or implied.

13. Changes to These Terms

We may update these Terms occasionally. If we make material changes, we'll notify you via email or an in-app banner at least 14 days in advance. Continued use of the Service after changes take effect means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, except where applicable consumer law requires otherwise.
